Uniform Civil Code – Once again, where is gender justice?

For nearly eight decades, the women’s movement has discussed and debated the desirability and feasibility of a Uniform Civil Code (UCC), and has ended up posing a simple question – what is the value of uniformity? Is it for the “integrity of the nation” that uniformity in laws is required, as some judicial pronouncements have suggested?  If so, who exactly is the beneficiary? Which sections of people benefit from “integrity of the nation”, that abstract entity which is not exactly at the top of your mind as your husband throws you out on the street?
Or are uniform laws meant to ensure justice for women in marriage and inheritance?
In that case, a UCC would simply put together the best gender just practices from all Personal Laws. So yes, polygamy and arbitrary divorce would be outlawed (a feature derived from Hindu Personal Law). But conversely, as feminist legal activist Flavia Agnes has often pointed out, a UCC would require the abolition of the Hindu Undivided Family, a legal institution that gives tax benefits only to Hindus, and all citizens of India would have to be governed by the largely gender-just Indian Succession Act, 1925, currently applicable only to Christians and Parsis.
Muslim Personal Law is already modern in this sense, since it has since the 1930s, enshrined individual rights to property, unlike Hindu law, in which the family’s natural condition is assumed to be “joint”. In the decades of the 1930s and 1940s, contrary to later discourses about Muslim law being backward, it was Hindu laws that were considered “backward” and needing to be brought into the modern world of individual property rights.
Again, since the Muslim marriage as contract protects women better in case of divorce than the Hindu marriage as sacrament, all marriages would have to be civil contracts. Mehr, in Muslim personal law, paid by the husband’s family to the wife upon marriage, is the exclusive property of the wife and it is hers upon divorce, offering her a protection Hindu women do not have. So, the Uniform Civil Code would make the practice of mehr compulsory for all while abolishing dowry.
The patent absurdity of these suggestions arises, not from the ideas themselves, but from the fact, recognized by everybody, that the talk of a “Uniform Civil Code” has nothing at all to do with gender justice. It has entirely to do with a Hindu nationalist agenda, and is right up there with the beef ban and the temple in Ayodhya. A UCC is meant to discipline Muslims, teach them (if they didn’t know it already) that they are second class citizens, and that they live at the mercy of “the national race” (the Hindus), as Golwalkar decreed.
So let us pose the question differently – who suffers in the absence of a UCC? Is it Muslim women, victims of polygamy and triple talaq, as Hindutvavadi wisdom has it? But for decades, feminist legal practice has successfully used both the Protection of Women from Domestic Violence Act (2005) that is available to all Indian citizens regardless of religious identity; as well as the Muslim Women Protection of Rights on Divorce Act (1986), to deal with polygamy and triple talaq, and to obtain maintenance, child custody and rights to matrimonial home, for countless Muslim women. In addition, feminist legal activists have used the landmark ruling Shamim Ara v State of UP (2002) to buttress their claim that arbitrary triple talaq is invalid.
Moreover, polygamy is not exclusive to Muslims. Hindu men are polygamous too, except that because polygamy is legally banned in Hindu law, subsequent wives have no legal standing and no protection under the law. Under Sharia law, on the contrary, subsequent wives have rights and the husband hase obligations towards them. If gender justice is the value we espouse, rather than monogamy per se, we would be thinking about how to protect “wives” in the patriarchal institution of marriage. “Wives” are produced through the institution of compulsory heterosexual marriage, the basis of which is the sexual division of labour. This institution is sustained by the productive and reproductive labour of women, and almost all women are exclusively trained to be wives alone.
Thus, when a marriage fails to fulfill its patriarchal promise of security in return for that labour, all that most women are left with is the capacity for unskilled labour. Or they remain trapped in marriage with children to provide for, while men marry again, legally or otherwise, producing still more dependent, exploited wives and children for whom they take no responsibility. If gender justice is the point of legal reforms, the centrality and power of the compulsory heterosexual, patriarchal marriage, and the damage it can do to women, is what must be mitigated. This would mean recognizing the reality of multiple “wives” as a common practice across communities, and the protection of the rights of all women in such relationships.
In this sense, recent Supreme Court rulings that have granted rights to second wives in Hindu marriages, dilute the legal standing of monogamy for Hindus, but empower women.
A survey conducted by Bharatiya Muslim Mahila Andolan, a significant voice in the debate, found that more than 90 percent of Muslim women in India want a ban on “triple talaq” and polygamy in Muslim Personal Law. That is, the demand is made within the framework of codifying Muslim Personal Law, not in favour of a UCC, partly because there is no clarity on what a uniform code would look like, but also because the demand comes from clearly Hindutvavaadi quarters which have shown that both women and minorities are expendable for them.
The only example of a uniform code in India is the Portuguese Civil Procedure Code (1939) of Goa, which is neither ‘uniform’ nor gender-just. Marriage laws differ for Catholics and people of other faiths, and if a marriage is solemnized in church, then Church law applies, permitting, for example, arbitrary annulment at the behest of one of the parties. The “customs and usages” of the Hindus of Goa are recognized, including “limited” polygamy for Hindus.
The positive aspect of Goa’s Civil Code is the Community Property Law, which guarantees each spouse 50% of all assets owned and due to be inherited at the time of marriage. However, this provision can be sidestepped in practice, given the power relations in a marriage, and studies show that it has not made any impact on the incidence of domestic violence.
Clearly, if gender justice is not prioritized, both uniformity as well as its dilution can reinforce patriarchy and majoritarianism.
The woman at the centre of this recent round of debate on the UCC is Shayara Bano, who received talaq by post. Her lawyer, instead of using any of the three recourses available, discussed above – the Protection of Women from Domestic Violence Act (2005), the Muslim Women Protection of Rights on Divorce Act (1986), or the citation of the judgement Shamim Ara v State of UP (2002) – decided to file a Public Interest Litigation in the Supreme Court challenging triple talaq on the grounds of violation of Fundamental Rights. Shayara Bano is now in the media spotlight, spiritedly criticizing patriarchy in the Muslim community.
Revealingly, a recent interview with her in a national newspaper concluded with a startling question – “What about the ‘Bharat Mata ki jai’ slogan controversy?” Shayara replies, “I feel all Muslims should say Bharat Maa ki jai.”
Does the question seem irrelevant in the context of Shayara Bano’s fight for personal justice? What does compulsory chanting of “Bharat Mata ki jai” have to do with a woman fighting patriarchy?
But the question does not seem irrelevant at all; it seems to be at the heart of the interview. This alone should alert us to what the demand for a UCC is actually about.

Kashmir – A lost battle: Amya

What’s happening in Kashmir? Why are the people living in the valley so angry? Why are they mourning at the death of a militant? What is giving them so much courage to shout slogans against the Indian state, even at the cost of their lives? Why do they assemble in large numbers at the funeral processions of the men killed in conflict?
As an Indian have you ever thought about these questions? Have you ever wondered that there must be something seriously turbulent in their reality that they are so resentful? Or, like the majority, you find yourself defending the unity of the country and calling the people living in Kashmir “traitors” or “anti-India.” If each and every person assembled in the funeral processions is a traitor then the best solution for the state is to kill all of them, stay happy with that piece of land and preserve the Indian unity. Has Indian nationalism become so narrow? We are the supposed carriers of the legacy of nationalism that Tagore had envisioned. But it’s now getting distorted into a revengeful and inhuman nationalism. We have lived the ‘unity in diversity’ phenomenon by being accommodative towards different communities. Why are we then so intolerant towards the people of Kashmir? Just because it is a matter of honour and pride for us to possess the land of Kashmir and further to prove our might, we keep eliminating any dissenting voice?
I have also often heard justifications of history. “Look what they did to the Kashmiri pandits, that was wrong. They deserve it.” Well if history is to be used as a justification then I guess nobody deserves to live. Whether it is Burhan Wani or the state armed forces, violence should and cannot be justified on any account. The state is vested with innumerable powers, it can address people’s needs and grievances if it wants to, but why is it that violence is seen as the only way to deal with the Kashmir issue? After Burhan is killed around thirty more have died and many continue to be injured and hospitalised. How long will this go on for? What have we anyway got from this tit for tat ideology?
It was July of last year that I was in Kashmir for my Ph.D research and I was seeing the pictures of the new militant group making the rounds on social media. As an Indian, I was intrigued and curious to know why are young boys again being drawn towards militancy. Why aren’t they happy with my country? What is wrong? Some of the answers to this I found in my interviews with boys from Palhaalan village in Baramulla district who had pelted stones in 2010. When I asked them about the reasons one of them said
When the militancy movement was at its peak in 1990s we lost our loved ones, we saw a lot of bloodshed and like me, many decided never to pick up the gun, because violence could not solve anything. So, when we got angry we would throw stones. Every household has lost somebody in the conflict, some have disappeared, some are disabled due to torture, women do not know if they are widows or not. It is but natural to feel angry. But despite our decision not to take to arms, just for throwing stones once, many of us are regularly picked up for interrogation and locked up on Indian Independence and Republic Day. They think we are terrorists. Where do we go for seeking justice?  We have been injured by pellets, some have lost their vision, some still have pellets in their bodies and our lives are ruined. Sometimes I feel it would have been better if we had picked up the gun just like Burhan. It would be better to die than live like this.
I guess those boys must have picked up the gun now. We have landed ourselves in a vicious cycle. More than violence, it was essential to understand the problems. Being a conflict zone, Kashmir needed extra humane care but our negligence, assumptions and violence resulted in many Burhans. We’ve killed a Burhan, hundred more will come and hundred more will be killed and more will come again and so on. What is it that we are getting at by resorting to violence? If we are trying to quell dissenting voices, it’s not helping because thousands and lakh more are resounding back. I have met mothers in the valley who feel proud when their sons die, they sing songs of glory at their sons’ funeral- these are ordinary women from villages- not ISI agents or paid by the media-simple mothers who are so unhappy that their only ray of hope is the son fighting a war because there is no other way that their grievances can be heard.
 I so wish that we had adopted a more humane approach with the people. We got so lost in the ‘us’ versus ‘them’ illusion that now it seems impossible to win their faith. Humanity is a language that transcends borders, religion and communities but we never believed in it. During my research, I made a number of friends studying in universities in Kashmir. I was always welcomed as a family member. Despite my different religion and my background, they did everything possible to help me with my field trips and research. But, today as an Indian I feel responsible for their grief. I have no idea how they are. They have no internet connection, no phone connection. I don’t know if they are dead or alive.
 The only thing we can do now is cry over spilled milk because Kashmir seems to be a lost battle. Yes, we can very well keep sending more armed forces, killing the civilians and rejoice at the possession of the land, but for generations to come, this will remain a black spot on the the Indian nation.

ASHOK AND INDIA

सांप्रदायिक राजनीति अपना एजेंडा लागू करने के लिए अतीत के इस्तेमाल में सिद्धस्त होती है। भारत के
मध्यकालीन इतिहास को पहले ही तोड़ा-मरोड़ा जा चुका है। मुस्लिम राजाओं को विदेशी आक्रान्ता व हिन्दुओं के पीड़क के रूप में प्रस्तुत किया जाना आम है। और अब, प्राचीन इतिहास को तोड़-मरोड़ कर ब्राह्मणवाद को बौद्ध धर्म से श्रेष्ठ सिद्ध करने का अभियान चल रहा है।
इस अभियान के अंतर्गत सांप्रदायिक ताकतों ने सम्राट अशोक पर निशाना साधा है। नोबेल पुरस्कार विजेता अमृत्य सेन के अनुसार, हमारे देश के दो सबसे महान शासक थे अषोक और अकबर। आरएसएस के अनुषांगिक संगठन वनवासी कल्याण परिषद की राजस्थान शाखा के एक प्रकाशन के अनुसार, अशोक के बौद्ध धर्म ग्रहण करने और अहिंसा को बढ़ावा देने से विदेशी आक्रांताओं के लिए भारत पर हमला करना और उस पर विजय प्राप्त करना आसान हो गया। प्रकाशन में यह भी कहा गया है कि अशोक के नेतृत्व में बौद्ध धर्मावलंबियों ने राष्ट्रविरोधी भूमिका अदा की। उन्होंने यूनानी आक्रांताओं की मदद की ताकि वे ‘‘वैदिक धर्म’’ का नाश कर बौद्ध धर्म को उसकी खोई प्रतिष्ठा फिर से दिलवा सकें। यहां जिसे वैदिक धर्म बताया जा रहा है, वह, दरअसल, ब्राह्मणवाद है।
यह दिलचस्प है कि इस लेख में कहा गया है कि बौद्ध धर्म अपनाने के पहले तक अशोक एक महान शासक थे। इसके विपरीत, अधिकांश इतिहासविदों और चिंतकों का मानना है कि अशोक की वे मानवीय नीतियां, जिन्होंने उन्हें महान बनाया, उनके द्वारा बौद्ध धर्म अपनाने के बाद ही अस्तित्व में आईं। अषोक के बारे में जो भ्रम फैलाया जा रहा है उसके कई आयाम हैं, जिन्हें ब्राह्मणवादी हिंदू धर्म की राजनैतिक आवष्यकताओं के अनुरूप गढ़ा गया है। इनमें से बसिरपैर की एक मान्यता यह है कि भारत हमेशा से राष्ट्र रहा है। तथ्य यह है कि भारत स्वाधीनता संग्राम के दौरान राष्ट्र-राज्य के रूप में उभरा। इसके पहले तक भारत में रियासतें और साम्राज्य थे। इन रियासतों और साम्राज्यों की सीमाएं निष्चित नहीं होती थीं और किसी रियासत या राज्य का आकार उसके शासक के साहस, महत्वाकांक्षा और सैन्य शक्ति सहित अन्य कारकों के आधार पर घटता बढ़ता रहता था। कई बार कुछ शासकों को अपने राज्य से पूरी तरह से हाथ धोना पड़ता था। अशोक के शासन के पहले भी सिकंदर ने भारत पर आक्रमण किया था। उस दौर में राजाओं द्वारा दूसरे शासकों की भूमि को हड़पने के प्रयास बहुत आम थे। प्राचीन भारत में मौर्य एक बड़ा साम्राज्य था।
भारतीय उपमहाद्वीप पर कई राजवंषों का शासन रहा है। परंतु ऐसा कोई शासक नहीं है जिसने आज के संपूर्ण भारत पर  शासन किया हो। तो फिर अशोक को निशाना क्यों बनाया जा रहा है? अशोक, मौर्य वंश  के शासक बिंदुसार के
उत्तराधिकारी थे। चंद्रगुप्त मौर्य ने इस साम्राज्य की नींव रखी थी और अशोक ने कलिंग (आज का ओडिसा) को साम्राज्य का हिस्सा बनाया था। कलिंग के युद्ध में भारी हिंसा हुई थी और इस खून-खराबे ने अशोक पर इतना गहरा प्रभाव डाला कि उन्होंने बौद्ध धर्म अपनाने का निर्णय ले लिया। इस तरह एक आक्रामक व असंवेदनशील शासक के मानवतावादी व्यक्ति में बदलने की प्रक्रिया अशोक द्वारा बौद्ध धर्म अपनाने से शुरू हुई। उन्होंने लोगों की भलाई के लिए कई कदम उठाए। ब्राह्मणवादी रूढ़ियों का विरोध किया और अपने महल के दरवाज़े, अपने साम्राज्य के उन लोगों के लिए खोल दिए जिन्हें किसी भी प्रकार की कोई परेशानी थी। बुद्ध की शिक्षाओं से प्रभावित होकर उन्होंने एक ऐसे राज्य का निर्माण किया जो सहृदय और जनता का संरक्षक था।
उनके विचार और उनकी नीतियां उनके शिलालेखों से जानी जा सकती हैं, जो देश के कई हिस्सों में स्तंभों और चट्टानों पर उत्कीर्ण हैं। इन शिलालेखों से पता चलता है कि ईसा पूर्व तीसरी शताब्दी में अशोक ने ऐसी नीतियां अपनाईं जो लोगों के प्रति प्रेम और सहानुभूति से प्रेरित थीं और जिनसे कोई भी प्रभावित हुए बिना नहीं रह सकता था। यह महत्वपूर्ण है कि बौद्ध धर्म अपनाने के बाद भी अशोक ने समाज की विविधता को खुले दिल से स्वीकार किया। उनका एक शिलालेख कहता है कि शासक को अपनी प्रजा की आस्थाओं में विविधता को स्वीकार करना चाहिए। उन्होंने बौद्ध धर्म को विष्व धर्म बनाया। उन्होंने अपने विचार तलवार के ज़ोर पर नहीं बल्कि षब्दों और तर्कों से फैलाए। उनका संदेष था कि दुनिया में कष्ट और दुःख कम करने के लिए हमें षांति, सहिष्णुता और खुलेपन की नीतियां अपनानी होंगी। इन कारणों से अशोक को महान बताया जाता है। इसके उलट, लेख में कहा गया है कि अशोक, बौद्ध धर्म अपनाने के पहले तक एक महान षासक थे।
भारतीय उपमहाद्वीप के इतिहास में अशोक से बड़े साम्राज्य पर किसी ने शासन नहीं किया। उनका धम्म शासक और प्रजा दोनों के लिए नैतिक संहिता का निर्धारण करता है। अषोक अपने प्रजाजनों से यह अपेक्षा करते थे कि वे भी नैतिकता के पथ पर चलेंगे। उनके षिलालेख 12 में जो लिखा है उसकी प्रासंगिकता आज भी है और हमें उसके षब्दों को याद रखना चाहिए। इस षिलालेख में सार्वजनिक जीवन में सहिष्णुता और सभ्य व्यवहार अपनाने की बात कही गई है। यह षिलालेख ‘‘वाणी के संयम’’, ‘‘अपने धर्म की तारीफ न करने’’ और ‘‘दूसरे के धर्म की निंदा न करने’’ की बात कहता है (सुनील खिलनानी, इंकारनेषन्सः इंडिया इन 501 लाईव्स, पृ. 52)। ‘‘उन्होंने बौद्ध धर्म को अपने प्रजाजनों पर नहीं लादा। उनकी षांति, दूसरों पर आक्रमण न करने और सांस्कृतिक विजय की नीतियों के कारण वे एक महत्वपूर्ण ऐतिहासिक चरित्र हैं’’ (आरएस षर्मा, एन्षियेंट इंडिया, एनसीईआरटी, 1995, पृ. 104)। वे उसी सांस्कृतिक व राजनैतिक बहुवाद के प्रतीक थे जो गांधी और नेहरू की
विचारधारा के केंद्र में थी। चार सिंहों का उनका प्रतीक, भारतीय मुद्रा में अंकित है और उनका चक्र, भारतीय राष्ट्रीय ध्वज का भाग है।
अशोक के षासन को कभी कोई सैन्य चुनौती नहीं मिली। वे 50 से भी अधिक वर्षों तक षासक रहे। 205 ईसा पूर्व में यूनानी सम्राट एन्टियोकस ने उत्तर-पष्चिम से आक्रमण किया और पंजाब व अफगानिस्तान सहित कुछ उत्तर-पष्चिमी हिस्सों पर कब्ज़ा कर लिया। अशोक को असली चुनौती बाहरी आक्रांताओं से नहीं बल्कि उनके साम्राज्य के अंदर से मिली। बौद्ध   धर्म के बढ़ते प्रसार पर ब्राह्मणवादी प्रतिक्रिया उनके लिए सबसे बड़ी समस्या थी। अशोक ने धार्मिक अनुष्ठानों के दौरान जानवरों की बलि देने पर प्रतिबंध लगा दिया था। इससे ब्राह्मणों की आय में कमी आई। बौद्ध धर्म के प्रसार के कारण वर्ण और जाति व्यवस्था कमज़ोर पड़ी। जिस धार्मिक धारा को सांप्रदायिक ताकतें वैदिक धर्म बता रही हैं वह दरअसल तत्समय में प्रभावकारी ब्राह्मणवाद था।
इन कारकों के चलते अशोक के साम्राज्य में प्रतिक्रांति हुई। प्रतिक्रांति का नेतृत्व किया अशोक के पोते बृहद्रथ के सेनापति पुष्यमित्र षुंग ने, जो कि एक ब्राह्मण था। उसने सम्राट को मौत के घाट उतार दिया और अशोक के साम्राज्य के सिंध के हिस्से में षुंग वंष के षासन की स्थापना की। इस प्रतिक्रांति के परिणामस्वरूप बौद्ध धर्म उसके मूल देष से गायब हो गया। अंबेडकर लिखते हैं, ‘‘सम्राट अशोक ने जानवरों की बलि देने पर पूरी तरह प्रतिबंध लगा दिया। इसके कारण लोगों ने धार्मिक कर्मकांड संपन्न करवाने के लिए ब्राह्मणों को बुलाना बंद कर दिया। ब्राह्मण पुरोहित बेरोज़गार हो गए। उनका महत्व और सम्मान भी कम हो गया। इसलिए ब्राह्मणों ने मौर्य सम्राट बृहद्रथ के विरूद्ध पुष्यमित्र षुंग के नेतृत्व में विद्रोह किया। षुंग एक सामवेदी ब्राह्मण था और बृहद्रथ की सेना का सेनापति भी’’ (राइटिंग एंड स्पीचेस, खंड-3, पृ. 167)।
आठवीं शताब्दी के बाद से षंकर ने बुद्ध की विचारधारा के खिलाफ वैचारिक लड़ाई जारी रखी। बुद्ध कहते थे कि यही दुनिया असली दुनिया है और हमें इसी पर अपना ध्यान केंद्रित करना चाहिए। षंकर कहते थे कि यह दुनिया एक माया है। शंकर की विचारधारा ने अंततः ब्राह्मणवाद को देश में पुनस्र्थापित कर दिया और 1200 ई. के बाद बौद्ध धर्म यहां से पूरी तरह गायब हो गया। फिर अषोक के षासनकाल को आलोचना का विषय क्यों बनाया जा रहा है? अषोक के बौद्ध धर्म अपनाने से ब्राह्मणवाद को बहुत बड़ा धक्का लगा। ब्राह्मणवाद, हिंदू धर्म पर हावी था। अषोक, अहिंसा और बहुवाद में विष्वास करते थे। ये दोनों ही मूल्य हिंदू राष्ट्रवादी एजेंडे के खिलाफ हैं, जिसकी  राजनीति का हिंसा अभिन्न भाग होती है। हिंदू राष्ट्रवादी भी ब्राह्मणवादी मूल्यों को बढ़ावा देना चाहते हैं। तो जहां एक ओर दलितों को संघ परिवार के झंडे तले लाने के प्रयास हो रहे हैं, वहीं बौद्ध धर्म पर हल्ला बोला जा रहा है और सामाजिक पदक्रम को बनाए रखने के सघन प्रयास हो रहे हैं। बौद्ध धर्म जातिविहीन समाज का प्रतीक था। वह बहुवाद और षांति का पैरोकार था। हिंदू राष्ट्रवादियों द्वारा अषोक पर हमला, दरअसल, इन्हीं मूल्यों पर हमला है। यह कहा जा रहा है कि अषोक के बौद्ध धर्म ग्रहण करने से ‘भारत’ कमज़ोर हुआ। सच यह है कि उस समय भारत अस्तित्व में ही नहीं था। मौर्य एक साम्राज्य था राष्ट्र-राज्य नहीं। साम्राज्य बनते-बिगड़ते रहते हैं। अहिंसा की नीति अपनाने के बाद भी मौर्य साम्राज्य 50 वर्षों तक बना रहा। उसे कमज़ोर किया ब्राह्मणवादियों ने। प्राचीन भारत के इतिहास के लेखन के काम में संघी इतिहासविदों की घुसपैठ का लक्ष्य अशोक और उन जैसे अन्य   शासकों के महत्व को कम करना और उन्हें बदनाम करना है।

शर्म कभी नहीं आएगी
केंद्र सरकार को अरुणाचल प्रदेश मामले में सुप्रीम कोर्ट से बड़ा झटका लगा है. कोर्ट ने नाबाम तुकी की सरकार को हटाने के केंद्र के फैसले को असंवैधानिक करार दिया है, और उसे तत्काल बहाल करने को कहा है. सुनवाई के दौरान सुप्रीम कोर्ट ने यहां तक कहा कि अगर घड़ी की सूई को पीछे ले जाना होगा तो ले जाएंगे. सुप्रीम कोर्ट ने केंद्र की बीजेपी सरकार के फैसले को पलट दिया है. अरुणाचल प्रदेश की नाबाम तुकी सरकार को हटाने के केंद्र के फैसले को असंवैधानिक करार देते हुए 15 दिसंबर 2015 की स्थिति लागू करने को कहा है. अरुणाचल पर सुप्रीम कोर्ट का ये फैसला 331 पन्नों का है 
सुप्रीम कोर्ट ने कहा, ''गवर्नर का काम केंद्र सरकार के एजेंट की तरह काम करना नहीं है। उन्हें संविधान के तहत काम करना होता है।''
- ''9 दिसंबर के बाद अरुणाचल असेंबली के सभी फैसले रद्द किए जाते हैं।''
- कोर्ट ने 16-17 दिसंबर को बुलाए गए विधानसभा सत्र को भी असंवैधानिक करार दिया।
 - किसी राज्य में मौजूदा सरकार को हटाकर पुरानी सरकार बहाल करने का सुप्रीम कोर्ट का यह पहला आदेश है।
- जस्टिस ए.के. माथुर ने  कहा, 'जिस तरह से पॉलिटिक्स गंदी हो रही है, नेता सरकार बनाने के लिए हॉर्स ट्रेडिंग करते हैं। ऐसे में सुप्रीम कोर्ट का ये फैसला ऐतिहासिक है।'
 जस्टिस जे एस केहर की अध्यक्षता वाली पांच जजों की संविधान बेंच ने अपने ऐतिहासिक फैसले में आदेश दिया कि विधानसभा में 15 दिसंबर 2015 से पहले की स्थिति बहाल रहेगी। 9 दिसंबर 2015 को दिए गए गवर्नर के आदेश पर लिए गए विधानसभा के सभी फैसले रद्द किए जाते हैं।
- जस्टिस केहर ने कहा, "9 दिसंबर 2015 को गवर्नर ने विधानसभा का सत्र 14 जनवरी 2016 से पहले 16 दिसंबर 2015 को ही खत्म करने आदेश दिया था। यह आर्टिकल 163 का (संविधान का आर्टिकल 174 पढ़ा जाए) वॉयलेशन है। लिहाजा, यह फैसला अमान्य है।"
- "दूसरा यह कि 16 से 18 दिसंबर 2015 तक चले अरुणाचल प्रदेश विधानसभा के 6th सेशन में कार्यवाही के लिए गवर्नर का आदेश देना आर्टिकल 163 का (संविधान का आर्टिकल 175 पढ़ा जाए) वॉयलेशन है। लिहाजा, इस फैसले को भी अमान्य किया जाता है।"
- "तीसरा यह कि गवर्नर के 9 दिसंबर 2015 के आदेश पर अरुणाचल प्रदेश विधानसभा द्वारा लिए गए सभी फैसले और उठाए गए कदम खारिज किए जाते हैं।"
- आखिर में बेंच ने कहा, "तीनों फैसलों को देखते हुए प्रदेश में 15 दिसंबर 2015 से पहले की स्थिति बहाल करने का आदेश दिया जाता है।"
उत्तराखंड के बाद अरुणांचल प्रदेश में केंद्र सरकार द्वारा सत्ता परिवर्तन कराये जाने के सम्बन्ध मेंमाननीय उच्चतम न्यायलय का फैसला आ जाने के बाद नरेन्द्र दामोदर मोदी व गृह मंत्री राजनाथ सिंह को कोई शर्म नहीं महसूस हो रही है. यह दोनों फैसले आने के बाद केंद्र में सत्तारूढ़ दल को तुरंत इस्तीफा दे देना चाहिए. न्यायपालिका के यह फैसले मील का पत्थर हैं और सरकार के खिलाफ महाआदेश है. सरकार में उच्च पदों पर बैठे हुए लोगों को न्यायपालिका डंडेबाजी नहीं करेगी फैसला ही दे सकती है. शर्म तो नरेन्द्र मोदी, राजनाथ सिंह और उनकी कैबिनेट में शामिल सुप्रीम कोर्ट में कार्यरत अधिवक्ताओं को आनी चाहिए.  इस फैसले के बाद भारत में लोकतंत्र व संविधान और मजबूत हुआ है.
